Delhi IAS Coaching Center: Advocate seeking urgent judicial intervention in systemic safety violations in coaching centers.
Advocate Satayam Singh of Supreme Court has submitted an open letter to the Hon'ble Acting Chief Justice of Delhi High Court, Justice Manmohan, seeking urgent judicial intervention to address systemic safety violations in coaching centers across Delhi.
The letter draws attention to recent tragic incidents, inter alia:
1. The demise of three students due to flooding at an IAS training academy in Old Rajendra Nagar on July 28, 2024.
2. A fire incident at a UPSC coaching center in Mukherjee Nagar on June 15, 2023, resulting in injuries to 61 individuals.
The petitioner contends that these incidents exemplify widespread non-compliance with various statutory provisions, including but not limited to:
a) Sections 331, 332, and 333 of the Delhi Municipal Corporation Act, 1957
b) Sections 25 and 26 of the Delhi Fire Service Act, 2007
c) Part 4 of the National Building Code of India
d) Rule 35 of the Delhi Fire Service Rules, 2010
Furthermore, the letter alleges violations of Supreme Court judgments, notably:
- M.C. Mehta vs Union of India & Ors (2004)
- Uphaar Cinema fire tragedy case (2003)
- Avinash Mehrotra vs Union of India & Ors (2009)
The petitioner has prayed for the following reliefs:
1. Issuance of directions for comprehensive safety audits of all coaching centers in Delhi.
2. Strict enforcement of MCD bylaws, fire safety norms, and building regulations.
3. Constitution of a special task force for conducting surprise inspections.
4. Mandating proper registration and licensing of coaching centers with safety compliance as a prerequisite.
5. Consideration of suo-moto action against non-compliant authorities.
6. Development of a comprehensive policy for regulating coaching centers.
The petitioner submits that these measures are imperative to safeguard the fundamental rights of students under Articles 21 and 21A of the Constitution of India.
